			<content:encoded><![CDATA[<p>The firm won a Motion to Dismiss a $100,000 tax deficiency in Utah federal district court. The firm argued that under <a href="http://www.law.cornell.edu/uscode/text/26/6502">IRC 6502</a> the government has ten years to collect a tax after it has been assessed, and that period had expired. In response, the government incorrectly argued that the period had been extended by a settlement agreement between the Defendant and the government. The Court agreed with <em>Wilenchik and Bartness</em> and ordered the suit dismissed.</p>

Brian also attended the State University at New Paltz where he received a Master of Arts, with primary focus on biological sciences. Mr. Schmidt received his Juris Doctor degree in 1998 from Pace University School of Law in New York.</p>
<p>While in law school Mr. Schmidt chaired the Philip B. Blank Committee on attorney Ethics in 1996. Mr. Schmidt was also the recipient of the Pauline V. and William F. Garvey Memorial Scholarship, and the Barbara Klein Memorial Award. Both of these accolades are in recognition of academic excellence.</p>
<p>In 1999, Mr. Schmidt moved his practice to Phoenix, Arizona. Mr. Schmidt has practiced in the areas of personal injury, medical malpractice, insurance bad faith and construction defect litigation.</p>
<p>Mr. Schmidt is a member of the Arizona, Maricopa County and American Bar Association and he is admitted to practice in all Arizona Courts, all New York Courts, United States District Court, District of Arizona, United States Court of Appeals, Ninth Circuit and the United States Supreme Court.</p>
